📷 Candid & Public Photography Policy

Photos taken of people in public spaces without their direct participation are subject to strict rules on this site. This page explains exactly what is and is not permitted.

ℹ️ The General Principle

People in public have a reduced expectation of privacy regarding their general appearance — but they retain a full expectation of privacy over body parts that are not intentionally exposed. A photo taken in a park of someone walking is very different from a photo taken up a skirt or down a shirt.

The test we apply: would a reasonable person object to this photo if they knew it was taken and posted? If the answer is yes — and especially if it involves private body parts — it is not allowed here.

✅ What Is Allowed

  • OK A girl standing next to her bike on the street in a skirt — nothing private visible, normal public appearance.
  • OK Someone at the beach or pool in normal swimwear, photographed from a normal standing angle.
  • OK A person jogging or walking in gym wear captured from eye level or above.
  • OK A crowd or street scene where an individual is incidentally included and nothing private is visible.
  • OK Someone sitting at an outdoor café in casual clothing, shot from the front or side at a natural angle.
  • OK Photos where the subject is clearly aware they are being photographed (e.g. posing for someone else nearby).

🚫 What Is NOT Allowed

  • NOT OK Upskirt — phone held at ground level aimed upward under a skirt or dress, regardless of what is visible.
  • NOT OK Downblouse — camera angled downward into a low neckline from above without consent.
  • NOT OK Someone bending over where their underwear or genitals are incidentally visible due to the camera angle chosen.
  • NOT OK A photo taken from behind closely following someone's buttocks as the clear primary subject.
  • NOT OK A person at the beach where the photographer has clearly zoomed in solely on their crotch or chest area.
  • NOT OK Any photo of this type involving a person who appears to be under 18 — regardless of what is visible.
  • NOT OK Photos taken in places with a clear expectation of privacy: changing rooms, bathrooms, bedrooms, medical facilities.

⚖️ This Is Also a Legal Issue

Taking or distributing non-consensual intimate images — including upskirt photos — is a criminal offence in Finland, across the EU, and in most US states. Being in a public place does not make it legal.

🇫🇮 Finland (server jurisdiction)

  • Criminal Code Chapter 24 §5 — Illegal observation (laiton tarkkailu): photographing someone in a private situation without consent is a criminal offence punishable by fines or up to 2 years imprisonment.
  • Criminal Code Chapter 24 §8 — Distribution of private sexual images: sharing intimate images of a person without their consent is a separate criminal offence.
  • Finnish courts have confirmed that being in a public space does not eliminate privacy rights over intimate body parts.

🇪🇺 European Union

  • GDPR (Regulation 2016/679): Photos of identifiable people are personal data. Hosting them without a lawful basis exposes the uploader — and potentially the platform — to enforcement by the Finnish Data Protection Ombudsman (tietosuojavaltuutettu), with fines up to €20 million.
  • Digital Services Act (DSA, Regulation 2022/2065): Platforms must have a working illegal content reporting mechanism and act promptly on valid notices. Failure to act after receiving notice of illegal content removes the hosting safe harbour.
  • Most EU member states also have national criminal provisions covering voyeurism and non-consensual intimate image sharing.

🇺🇸 United States

  • SHIELD Act (2022): Federal law criminalising the non-consensual sharing of intimate visual depictions, regardless of where they were originally taken.
  • State laws: Nearly all 50 states have specific voyeurism or upskirt statutes. Many classify distribution as a felony. Some states (e.g. California, Texas, New York) include explicit coverage of images taken in public.
  • 18 U.S.C. § 2256 and COPPA: Additional federal exposure where any person under 18 is involved.

Uploading prohibited material to this site does not protect you from prosecution under any of these laws. We retain uploader IP addresses and account data and cooperate fully with law enforcement requests from any jurisdiction.

🛡️ How We Moderate This

Photos flagged as candid or suspicious are reviewed by our moderation team before approval. Our automated systems also scan for camera angles and framing patterns associated with non-consensual photography.

If a photo is found to violate this policy after approval it will be permanently removed, the uploader's account will be banned, and the photo may be reported to authorities depending on severity.
